Focus & Scope

Aim and Objectives

Istinbath: Jurnal Penelitian Hukum Islam (p-ISSN: 1907-8064; e-ISSN: 2807-7520) is a peer-reviewed, open-access scholarly journal published by the Faculty of Sharia and Law, Universitas Islam Darussalam (UID) Ciamis, West Java, Indonesia.

The journal aims to provide an international intellectual forum for legal scholars, jurists, academics, and practitioners to publish and disseminate rigorous research and conceptual discourses on Islamic law (Sharia and Fiqh). It is dedicated to bridging traditional Islamic legal hermeneutics with contemporary legal systems, public policy, and socio-legal dynamics.

Focus

Istinbath specializes in both doctrinal (normative-theological) and non-doctrinal (empirical/socio-legal) inquiries. The journal emphasizes critical analysis, legal reasoning, methodology of Islamic legal deduction (ijtihad and istinbath al-ahkam), and the application of Islamic jurisprudence in modern societal and constitutional frameworks.

Scope and Thematic Areas

The journal invites original research articles, comparative analyses, and in-depth conceptual studies across the following core themes:

  • Islamic Jurisprudence and Legal Theory (Usul al-Fiqh & Qawa'id Fiqhiyyah): Classical and contemporary methodologies of legal reasoning, ijtihad, maqasid al-shari'ah (higher objectives of Islamic law), and legal hermeneutics.

  • Islamic Family and Personal Law (Ahwal al-Syakhshiyyah): Marriage, divorce, child custody, inheritance, wills, and gender justice within Muslim family legal reforms.

  • Islamic Economic and Commercial Law (Fiqh Muamalat): Islamic banking and financial regulations, contracts (aqd), waqf, zakat, consumer protection, and digital economy compliance.

  • Islamic Constitutional, Public, and Criminal Law (Siyasah Syar'iyyah & Jinayah): Islamic governance, human rights, religious freedom, state-religion relations, and restorative justice within Islamic criminal law.

  • Socio-Legal Studies and Living Law: Empirical examinations of Islamic law in practice, customary law ('urf), court decisions (religious judiciary / Peradilan Agama), and the socio-cultural reception of Islamic legal norms.

  • Comparative Law and Contemporary Legal Issues: Intersections of Islamic law with statutory/national law, international law, medical ethics/bioethics, environmental law (fiqh al-bi'ah), and emerging technological developments.
